TYC Burned With Pepper Spray Lawsuit

The Texas Youth Commission was in court Monday defending itself against advocacy groups claiming the TYC has overused pepper spray on its inmates. Texas Appleseed and Advocacy, Inc. say the TYC has doubled its use of pepper spray even after a settlement with the TYC back in September forced them to cut back.

TYC has not commented on the case but Jim George, an Austin attorney who chairs the Texas Appleseed board, said: "We had an agreed order signed by a judge, and they have not complied with it. It's unusual for people to say to a district judge, 'I will do something' and then just not do it."

The Travis County judge has ordered that the groups come to an agreement by Wednesday. If they do not, hearings will resume after Thanksgiving.
